This website (the “Website”) is owned by Orthexa d.o.o.

The information, tools and services on this Website are provided subject to these terms and the policies and notices referred to here.

By visiting the Website or buying an item, you use our “Service” and agree to these terms and conditions (“Terms”), including the additional policies linked from them. They apply to all Website users. Nothing in these Terms limits consumer rights that cannot lawfully be excluded.

Please read these Terms carefully before using the Website.

If you do not agree to these Terms, please do not use the Website or its services. Your statutory consumer rights remain unaffected.

Any new features or tools added to the online store are also subject to these Terms. The latest version is available on this page.

We may update, change or replace parts of these Terms by publishing an updated version on the Website, subject to applicable law.

Please check this page for updates. Changes will not retrospectively remove your rights under an order already placed.

2. Using the online store

You must not use our products or services for unlawful or unauthorized purposes, or breach the laws that apply to you, including copyright law.

We may refuse service where permitted by applicable law.

4. Accuracy and currency of information

The Website may contain historical information provided for reference. We may change Website content from time to time. Please check for updates on the Website. This does not limit our obligations to provide accurate product and order information.

5. Changes to services and prices

Product prices may change. The price agreed when your order is accepted is not changed retrospectively.
We may change or discontinue parts of the Service, subject to our obligations for existing orders and applicable law.
Our responsibility for any change, suspension or discontinuation remains subject to applicable law and rights that cannot be excluded.

6. Products and services

Some products or services may be available only online or in limited quantities. Returns and exchanges are subject to applicable consumer law and our Returns and refunds policy.
We aim to show product colors and images accurately, but colors can look different on different screens.
Product descriptions and prices may be updated. This does not change the terms agreed for an accepted order.
Preferences vary, but this does not affect your rights to receive goods that meet applicable standards and match their description.

7. Account and order information

Where permitted by law, we may refuse an order or limit quantities per person, household or order. This may include orders using the same account, billing or delivery address, or payment card.
If we change or cancel an order, we will try to contact you using the email address, billing address or telephone number supplied with it.
Please provide current, complete and accurate account and order information. Keep relevant details up to date so we can process your transaction and contact you when needed.

We may provide access to third-party tools which we do not operate or control.
These tools are provided on an “as is” and “as available” basis, subject to applicable law and without endorsing the third-party provider.
Before using a third-party tool, read the provider’s terms and make sure they are suitable for your needs. This does not exclude any responsibility that cannot lawfully be excluded.
Any new service or feature introduced in the future is also subject to these Terms.

Some content, products or services available through the Service may include third-party material.
Links may take you to websites that are not operated by Orthexa. We do not control their content or services. Any limitation of our responsibility is subject to applicable law.
Questions about a third party’s own products or services should be addressed to that provider. For anything you bought from Orthexa, you can contact us about your consumer rights.

10. Comments, feedback and submissions

If you send us ideas, suggestions or other material (“comments”), you give us permission to use, edit, reproduce, publish, distribute and translate them for the purpose for which they were submitted, subject to applicable law and privacy rights.
Unless we agree otherwise or the law requires it, we do not promise payment for unsolicited comments or a response to every submission. Personal data remains subject to our Privacy policy.
We may review, edit or remove material that is unlawful, abusive, threatening, defamatory, obscene, infringes another person’s intellectual property rights or breaches these Terms.
Your comments must not infringe another person’s rights. Do not use a false email address, impersonate someone else or mislead us or others about the origin of a submission.

12. Errors and inaccuracies

Occasionally, information about product descriptions, prices, promotions, shipping costs, delivery times or availability may contain an error or omission.
We may correct inaccurate information and, where permitted by applicable law, contact you about changing or cancelling an affected order. This does not remove your rights under an existing contract.
We will update or clarify information where required by applicable law.

13. Prohibited uses

You must not use the Website or its content:

for an unlawful purpose;
to encourage or take part in unlawful activity;
to breach applicable international, national, state or local laws or regulations;
to infringe our intellectual property rights or those of another person;

We may restrict access to the Service if you breach these rules, subject to applicable law.

14. Warranties and liability

We cannot promise that the Website will always be available, uninterrupted or free from technical errors.
The Website is provided on an “as is” and “as available” basis where permitted by law. This does not remove any statutory rights or mandatory guarantees relating to goods or services you buy from us.
To the extent permitted by applicable law, we limit liability for losses arising from use of the Website, including indirect or consequential business losses. We do not exclude liability that cannot legally be excluded, or your statutory rights in relation to purchased goods.

Where applicable law does not allow a particular exclusion or limitation, that exclusion or limitation does not apply.

15. Third-party claims

To the extent permitted by applicable law, you may be responsible for reasonable losses or third-party claims caused by your unlawful use of the Website or a breach of another person’s rights. This clause does not require you to cover losses caused by our own breach of duty or limit mandatory consumer protections.

16. Severability

If a provision is unlawful or unenforceable, it will apply only to the extent permitted by law, or be removed where necessary. The remaining provisions continue to apply.

17. Termination

Rights and obligations that arose before termination continue where applicable after the agreement ends.
These Terms apply while you use the Service. You may stop using the Website or notify us that you no longer wish to use our services. Ending use does not cancel an existing purchase contract automatically.
Where permitted by law, we may suspend or end access if you breach these Terms. Any amounts lawfully due for an existing order remain payable.

18. Entire agreement

If we do not immediately enforce a right or provision, this does not mean we waive it.
These Terms and the policies expressly referred to in them form the agreement governing use of the Service, subject to the information and terms applicable to an accepted order and any rights provided by law.
Any ambiguity will be interpreted in accordance with applicable law, including rules protecting consumers.

19. Governing law

These Terms are governed by applicable Slovenian law and relevant EU law. This does not deprive you of mandatory consumer protections that apply in your country of residence or restrict rights that cannot lawfully be excluded.

We may publish updated Terms on the Website. Please check this page for changes; updates remain subject to applicable law.

Updated Terms apply to future use as permitted by law and do not retrospectively remove rights under existing orders.

Additional purchasing terms

A. How a purchase contract is formed

A purchase contract between you and Orthexa d.o.o. is formed when you place an order on the Website and receive our order confirmation by email.

The agreed prices and other order terms then apply to both you and Orthexa d.o.o., subject to applicable law.

When you buy an item, we provide information including:

B. Returns and product complaints

Contact us if an item is faulty, damaged or does not match its description. Please keep it clean and return the original packaging where reasonably possible. Your statutory rights do not depend on keeping the original packaging or on the item being unused when a fault is discovered.
We aim to represent products accurately. Screen colors can vary, but your rights remain if an item is materially different from its description or is faulty. Contact us so we can arrange the appropriate remedy under applicable law.

C. Privacy and consent

D. Complaints and disputes

We aim to resolve complaints fairly and efficiently in line with applicable consumer law. If you have a complaint, contact us at [email protected].

We will handle your complaint with appropriate confidentiality. Where possible, we aim to resolve disputes amicably without court proceedings, without limiting your legal rights.

E. Alternative dispute resolution

Orthexa does not currently commit to a particular alternative dispute resolution provider, except where required by applicable law. The European Commission’s former online dispute resolution platform closed on July 20, 2025. F. Prices, currencies and taxes

Prices are displayed in EUR for Ireland, GBP for the United Kingdom and USD for the United States. The same nominal product price applies in each currency, rather than a currency conversion. Displayed prices include VAT where applicable. Your order total and any delivery charges are shown at checkout before you place the order.

G. Payment methods

The payment methods available for your order are shown at checkout.

Available payment options – Choose from the methods displayed for your delivery country.
Card payments – If card payment is offered, follow the secure checkout instructions.
Other payment methods – Any additional options and their instructions are shown at checkout.

H. Promotions

We may offer discounts and other promotions for a limited time. A promotional price applies to orders placed during the stated offer period.
Some promotions may be limited to new customers who have not ordered before. We may refuse a promotion that is being misused, subject to applicable law.
Discounts and promotions normally cannot be combined unless the offer expressly says otherwise.

We work to keep product availability accurate and dispatch orders within the stated timeframe.

We will contact you if an item is unavailable or there is a significant delay.

J. Intellectual property

Website text, images, videos, graphics and other material are protected by copyright and other intellectual property rights. Using the Website or buying an item does not transfer ownership of those rights. Unless we give permission or the law allows otherwise, you may use Website material only for personal, non-commercial purposes.

K. Website liability

Please use the Website responsibly and follow its instructions.
We cannot guarantee uninterrupted or error-free operation of the Website. We remain responsible for information and services to the extent required by applicable law.
Any limitation of liability is subject to applicable law and does not remove mandatory consumer rights or liability that cannot legally be excluded.
Using an online payment method does not waive any payment protections or other rights available to you under applicable law.
